August 26, 2009 IC/Fingerprinting Update: On August 6, 2009 a revision to 12VAC5-481-451, "Increased Controls and Fingerprinting" became effective. The revision included a requirement to also notify the NRC for any theft, sabotage or diversion; also notify the NRC when a shipment becomes lost; corrects the address to send fingerprints to; and to also notify the NRC when a fingerprinted individual is on the FBI's Terrorist Screening Database. August 21, 2009 Licensing Update : Sorry for the length in time since the last update but as you can imagine we are a little busy. The staff has been working an amending licenses and issuing the new Virginia license. For those licensees who possessed a Virginia NARM medical license and an NRC medical license prior to the Agreement date of March 31, 2009, the NARM license is no longer needed. The isotopes identified in the NARM license are now covered by your NRC license, we will no longer be asking you to renew the NARM license. I have spoken with the nuclear pharmacies and explained this to them. We will issue you a new Virginia radioactive materials license during your next amendment, renewal or through administrative actions on our part. I plan on issuing new licenses to those licensees who possessed a medical NARM license no later than March of 2010.
August 21, 2009 Fee Schedule Update: As most of you know there has been some confusion with regards to the fee schedule. Let me first begin by apologizing for any confustion we may have caused by our letter and/or the power point presentation. VDH is using a different billing cycle than the NRC, ours is based upon the expiration month listed on your license. What that means is that every year your annual license fee will be due by the end of that month, we will be sending you the invoice 60 priors to ensure you have enough time to process the check. At this time we can only accept a check for payment, we can not except credit cards or electronic deposits. The first letter you received from us was to cover the period April 1, 2009 until the month of your license expiration for this year only. For instance if your license expiration date is September 30, 2012 the letter invoiced you for the period April 1, 2009 until September 30, 2009. The amount was a prorated portion of the annual fee schedule based upon the number of days. Next you would have received an annual invoice for the period October 1, 2009 until September 30, 2010.
August 21, 2009 Fee Schedule Revision: On Tuesday August 18, 2009 we received a petition to amend the fee schedule, 12VAC5-490. The Radioactive Materials Program has been working with management to address the fee schedule issue and has prepared a new schedule for the Board of Health to review at their next meeting being held on October 16, 2009. The petition has been posted on the Virginia Town Hall website, at the following location:12VAC5-490 Petition. March 18, 2009 Update: My thanks to all the individuals who took time out of their work schedule to come to our agreement state meetings. Each meeting was fruitful and many questions were answered. We are working on posting the questions here for everyone to see. I am posting the presentation here for anyone that was unable to be at these meetings. March 18, 2009 Update: On March 4, 2009 the NRC Chairman signed our agreement. Subsequently the agreement has been delivered to the Governor for signature. Once the agreement is signed by Governor Kaine it will be delivered to the NRC. On March 31, 2009 the agreement will become effective and the NRC will deliver the licensing files to our office. March 27, 2009 Update: On March 23, 2009 the signed agreements were delivered to the NRC. On March 24, 2009 the NRC issued a press release stating: "NRC COMPLETES VIRGINIA AGREEMENT TO REGULATE CERTAIN RADIOACTIVE MATERIALS". So beginning 12:00 a.m. on March 31st the Radioactive Materials Program will have authority over the licensing of radioactive materials in the Commonwealth of Virginia. If you have an amendment request you may either mail them or fax them to us, but please bear with us for the first couple of weeks as we must accept the NRC licensing files and place them in our filing system.

"Purpose: To protect the public and occupational radiation workers, and to maintain effective control over licensed radioactive materials to ensure their safe handling and disposal."
This program is responsible for ensuring the safe use of radioactive materials in such areas as industrial, medical, educational and research applications. The safe use of radioactive materials is ensured by issuing licenses which state the conditions of use. The facilities are inspected to ensure compliance with these conditions. Currently approximately 220 radioactive material licensees in Virginia are authorized to possess and use radioisotopes under specific conditions. These licenses regulate naturally occurring and accelerator produced radioisotopes. Currently, there are no fees associated with the radioactive materials licensing program.
On occasion, unidentified but low level radioactive material (<50 mr/hr) in scrap metal or refuse is detected on arrival at facilities providing recycling, disposal or incineration services. In such cases this agency has been authorized by the U. S. Department of Transportation (DOT) to issue DOT transportation exemptions for the return of the material to the original shipper.
