{"id":146,"date":"2016-05-03T01:22:09","date_gmt":"2016-05-03T01:22:09","guid":{"rendered":"https:\/\/www.vdh.virginia.gov\/environmental-health\/?page_id=146"},"modified":"2024-11-01T12:16:17","modified_gmt":"2024-11-01T16:16:17","slug":"news-of-interest","status":"publish","type":"page","link":"https:\/\/www.vdh.virginia.gov\/environmental-health\/onsite-sewage-water-services-updated\/news-of-interest\/","title":{"rendered":"News of Interest"},"content":{"rendered":"<p>&nbsp;<\/p>\n<span class=\"collapseomatic \" id=\"id6a147605c03b1\"  tabindex=\"0\" title=\"Development of Rainwater Harvesting Regulations\"    >Development of Rainwater Harvesting Regulations<\/span><div id=\"target-id6a147605c03b1\" class=\"collapseomatic_content \">\n<p>September 7, 2021<\/p>\n<p>Chapter 817 of the 2018 Virginia Acts of the Assembly (<a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?ses=181&amp;typ=bil&amp;val=hb192\">House Bill 192<\/a>) provides authority for VDH to develop regulations for the harvesting of rainwater. House Bill 192 provides authority for VDH to <em>adopt regulations<\/em>\u00a0regarding the use of rainwater which shall<em>\u00a0<\/em>describe the conditions under which rainwater may appropriately be used and for what purposes; and shall also provide standards for the use of rainwater harvesting systems, including systems that collect rainwater for use by commercial enterprises but do not provide water for human consumption, as defined in \u00a7\u00a0<a href=\"https:\/\/law.lis.virginia.gov\/vacode\/title32.1\/chapter6\/section32.1-167\/\"><strong>32.1-167<\/strong><\/a>.<\/p>\n<p>In addition, House Bill 192 directs VDH, in conjunction with the Department of Environmental Quality (DEQ), to promote the use of rainwater as means to reduce fresh water consumption, ease demands on public treatment works and water supply systems, and promote conservation. Following publication of the amendments, a public comment period will open for 30 days on Virginia\u2019s online Town Hall. (Draft first posted December 18, 2020). Comments may be sent to Marcia.degen@vdh.virginia.gov. Please note that the proposal has not entered into the regulatory process and this first draft is part of a consensus building process. Additional drafts will be developed as needed.<\/p>\n<p>In an effort to gain input on specific questions, VDH has developed a <strong>survey<\/strong>. The survey is open to public and private individuals and the results will be used to help guide the next draft. Survey responses will be accepted through <strong>January 22, 2021<\/strong>. You can find the <strong>survey <\/strong><a href=\"https:\/\/docs.google.com\/forms\/d\/e\/1FAIpQLSePkLUQE-scAvlmXGXoU2TTpyU9Kdp9qYmzs0KcMtec29Mbdw\/viewform?usp=sf_link\">here<\/a>.<\/p>\n<p>12\/18\/2020<\/p>\n<p>The Virginia Department of Health (VDH) is proposing changes to the Sewage Handling and Disposal Regulations (12VAC5-610) that incorporate onsite sewage design elements from rescinded GMP 147.\u00a0 The process has just started and VDH is soliciting comments on a First Draft.<\/p>\n<ul style=\"list-style-type: circle;\">\n<li><a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/20\/2020\/12\/GMP-147-pertinent-sections.pdf\">GMP-147 &#8211; pertinent design element sections<\/a><\/li>\n<\/ul>\n<ul style=\"list-style-type: circle;\">\n<li><a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/20\/2020\/12\/12-16-2020-Version-to-SHADAC-and-VDH.docx\">First Draft 12 16 2020 Version to SHADAC and VDH<\/a><\/li>\n<\/ul>\n<ul style=\"list-style-type: circle;\">\n<li><a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/20\/2020\/12\/December-16-2020-Fast-Track-Reg.pdf\">December 16 2020 Fast Track Reg<\/a> Presentation<\/li>\n<\/ul>\n<p>Comments are due January 15, 2021.\u00a0 There WILL be a second draft round and a second request for comments in the future.<\/p>\n<p>February 28\/2021<\/p>\n<p><a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/20\/2021\/02\/Comments-as-01-15-2021-Fast-Track-for-GMP-147.docx\">Comments as 01 15 2021 &#8211; Fast Track for GMP 147<\/a><\/p>\n<\/div>\n<hr \/>\n<span class=\"collapseomatic \" id=\"id6a147605c0486\"  tabindex=\"0\" title=\"Revisions to the Sewage Handling and Disposal Regulations\"    >Revisions to the Sewage Handling and Disposal Regulations<\/span><div id=\"target-id6a147605c0486\" class=\"collapseomatic_content \">\n<p>VDH is currently in the process of developing revisions to the Sewage Handling and Disposal Regulations (12VAC5-610).\u00a0 To assist in development of these revisions several small stakeholder workgroups were put together to look at specific components of the regulations.\u00a0 Those workgroups meet several times during the summer of 2024.\u00a0 VDH will be presenting the general feedback from those workgroups at the 2024 Virginia Onsite Wastewater Recycling Association conference on November 5, 2024.\u00a0 The session will be open to the public.\u00a0 Notes from previous workgroup meetings can be found on Virginia Townhall at www.townhall.virginia.gov.\u00a0 VDH will update this site with post of draft language as the process moves forward.\u00a0 One suggested revision is to create a guidance document on the general criteria for conducting site and soil evaluations (see below).\u00a0 This document is draft and for discussion purposes only.<\/p>\n<p><a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/20\/2024\/11\/General-Criteria-for-Conducting-Site-Evaluations.doc\">https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/20\/2024\/11\/General-Criteria-for-Conducting-Site-Evaluations.doc\u00a0<\/a><\/p>\n<\/div>\n<hr \/>\n<span class=\"collapseomatic \" id=\"id6a147605c04d1\"  tabindex=\"0\" title=\"TL-3 General Approval for Clearstream N Model Expires December 31, 2018\"    >TL-3 General Approval for Clearstream N Model Expires December 31, 2018<\/span><div id=\"target-id6a147605c04d1\" class=\"collapseomatic_content \">\nClearstream Wastewater Systems, Inc. <u>opted not to re-apply<\/u> for its TL-3 General Approval for the Clearstream N models<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>.<\/p>\n<p><strong>The TL-3 general approval for the Clearstream N unit expires December 31, 2018<\/strong>. Only the TL-3 general approval will expire. <u>The Clearstream N model maintains its generally approved status for treatment level 2 (TL-2<\/u>). The Clearstream N model is not and has not been recognized as a nitrogen reducing unit.<\/p>\n<p>This includes <strong><u>ALL N<\/u><\/strong> models such as the N, NC, NC2, NC3, NC3T, and NU.<\/p>\n[Clearstream applied for and received TL3 general approval for its Model D units on November 28, 2018. See website under <a href=\"https:\/\/www.vdh.virginia.gov\/environmental-health\/onsite-sewage-water-services-updated\/onsite-sewage-system-septic-system-component-approvals\/treatment-devices-and-systems\/evaluation-completed\/\">GMP 2016-03<\/a> for details.]\n<p>Existing valid construction permits and construction permit applications received on or before December 31, 2018, proposing to utlize Clearstream N units are unaffected.\u00a0 The Clearstream N unit may be installed under those permits and are subject to sampling requirements for generally approved units\u00a0 (12VAC5-613-100D). When a Clearstream N unit is proposed for construction permit applications\u00a0received after December 31, 2018, the unit will be considered generally approved for Treatment Level 2 (TL-2) only.<\/p>\n<p>Existing\u00a0units installed on or prior to December 31, 2018, in association with an approved construction permit\u00a0for both onsite sewage and stream discharging systems, retain their TL-3 general approval status.<\/p>\n<p>FAQ\u2019s<\/p>\n<p><em>I submitted a construction application for an onsite sewage system on December 20, 2018,\u00a0that requires TL-3 and proposes\u00a0a Clearstream N unit to comply with TL-3 treatment standards. Will my application be denied?<\/em><\/p>\n<p>No. The Clearstream N model does not lose its TL-3 general approval until December 31, 2018. Applications proposing\u00a0Clearstream N models received on or prior to\u00a0December 31, 2018, \u00a0will be considered\u00a0with the TL-3 general approval.<\/p>\n<p><em>I have a project that I will submit on January 15, 2019, that I intend to use a Clearstream N unit to meet the TL-3 requirement for the site.\u00a0 Will that permit be denied?<\/em><\/p>\n<p>For this application\u00a0submitted after December 31, 2018, the Clearstream N unit will not be\u00a0generally approved for TL-3.\u00a0 If the application is submitted by a professional engineer under\u00a0Virginia Code 32.1-163.6, an engineer may propose the unit\u00a0as non-generally approved for TL-3.\u00a0 Additional\u00a0sampling under 12VAC5-613-100E for non-generally approved units will be required.<\/p>\n<p><em>I have a discharging system with a Clearstream N unit installed to meet the TL-3 requirement. Will I have to change out my unit when my permit is renewed?<\/em><\/p>\n<p>No. Installed units will maintain their general approval status.<\/p>\n<p>_____________<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> On July 13, 2010, the Virginia Department of Health (VDH) issued a Treatment Level 3 (TL-3) general approval for the Clearstream N treatment unit under the <em>Emergency Regulations for Alternative Onsite Sewage Treatment Systems<\/em> (12VAC5-613, <em>Emergency Regulations<\/em>) and in accordance with the procedures outlined in Guidance, Memorandum, and Policy (GMP) 147.\u00a0\u00a0 The final regulations, <em>Regulations for Alternative Onsite Sewage Systems <\/em>(12VAC5-613, <em>AOSS Regulations<\/em>) replaced the <em>Emergency Regulations<\/em> and were adopted on December 7, 2011. The <em>AOSS Regulations<\/em> include a stipulation in 12VAC5-613-30.L that all currently generally approved treatment units shall retain such status for 5 years, after which the units shall be evaluated pursuant to the requirements of the regulations. Subsequently, Clearstream applied for and received a variance to extend the TL3 general approval to December 31, 2018.<\/p>\n<\/div>\n<hr \/>\n<span class=\"collapseomatic \" id=\"id6a147605c052f\"  tabindex=\"0\" title=\"Periodic Review of the Regulations for Alternative Onsite Sewage Systems (Last Updated June 6, 2019)\"    >Periodic Review of the Regulations for Alternative Onsite Sewage Systems (Last Updated June 6, 2019)<\/span><div id=\"target-id6a147605c052f\" class=\"collapseomatic_content \">\n<p>Update June 6, 2019<\/p>\n<p>The update process for the Regulations for Alternative Onsite Sewage System Regulations (AOSS Regulations), <a href=\"https:\/\/law.lis.virginia.gov\/admincode\/title12\/agency5\/chapter613\/\">12VAC5-613<\/a>, has entered it first official step:\u00a0 Publication of the Notice of Intended Regulatory Action (NOIRA).\u00a0 The NOIRA describes the update proposed and allows for comments to be submitted by the public.\u00a0 You can find the NOIRA and the comment page<a href=\"http:\/\/townhall.virginia.gov\/L\/ViewStage.cfm?stageid=8572\"> here<\/a>.\u00a0 The public comment period ends June 28, 2019.<\/p>\n<p>VDH has compiled all of the comments received to date prior to the start of the NOIRA comment period.\u00a0 This compilation organizes the comments by regulatory section from the stakeholder meetings described below as well as additional comments received by staff through June 6, 2019.\u00a0 VDH will create a new draft from the accumulated comments plus any new comments received during the NOIRA comment period.\u00a0 The new draft will be posted here as well as distributed through normal channels.\u00a0\u00a0 <a href=\"https:\/\/www.vdh.virginia.gov\/content\/uploads\/sites\/20\/2019\/06\/Composite-Comments-06-06-2019.docx\">Composite Comments 06 06 2019<\/a><\/p>\n<p>*******************************************************************************************************<\/p>\n<p>The Virginia Department of Health (VDH) proposes to update the Regulations for Alternative Onsite Sewage Systems (AOSS Regulations), <a href=\"https:\/\/law.lis.virginia.gov\/admincode\/title12\/agency5\/chapter613\/\">12VAC5-613<\/a>. Virginia Code \u00a7 32.1-163.2 requires the Board of Health to develop and revise a five-year plan for the handling and disposal of onsite sewage. The Board must report to the Governor and the General Assembly every five years on the status of the onsite sewage program in Virginia and the health department\u2019s long-range plan. This report describes the Virginia Department of Health\u2019s (VDH) onsite sewage and water supply program.<\/p>\n<p><a href=\"http:\/\/leg2.state.va.us\/dls\/h&amp;sdocs.nsf\/4d54200d7e28716385256ec1004f3130\/e865f020df9f765b85257948007665b6?OpenDocument\">Long Range Plan for Onsite Sewage<\/a><\/p>\n<\/div>\n<hr \/>\n<span class=\"collapseomatic \" id=\"id6a147605c060a\"  tabindex=\"0\" title=\"Board of Health approves fast-track amendments to the Alternative Onsite Sewage System Regulations\"    >Board of Health approves fast-track amendments to the Alternative Onsite Sewage System Regulations<\/span><div id=\"target-id6a147605c060a\" class=\"collapseomatic_content \">\nOn December 1, 2016, the Board of Health approved fast-track amendments to the\u00a0Regulations for Alternative Onsite Sewage Systems (12VAC5-613, AOSS Regulations), which\u00a0establish performance and operation and maintenance requirements for alternative onsite sewage systems.\u00a0 The draft fast-track amendments change the definition of \u201cdirect dispersal of effluent to groundwater,\u201d also known as \u201cdirect dispersal,\u201d (12VAC5-613-10), and adds a new section (12VAC5-613-90.E) revising performance requirements of repairs and voluntary upgrades.<\/p>\n<p>The fast-track amendments will encourage owners with older septic systems to improve treatment from what is currently dispersed, resulting in greater public health protection.\u00a0 The requirements for direct dispersal contained in the AOSS Regulations have proven to be an economic stumbling block for owners who want to repair or upgrade older septic systems with newer technology.\u00a0 The draft requirements would only be available to owners of sewage systems already dispersing effluent into groundwater with an average sewage flow of 1,000 gallons\/day or less.<\/p>\n<p>The Sewage Handling and Disposal Advisory Committee, consisting of over 15 stakeholder groups, reviewed the fast track amendments for a second time at its September 15, 2016, meeting.\u00a0 All but one of the stakeholders approved the fast-track amendments.\u00a0 The one dissenting vote resulted from the stakeholder wanting the fast track amendments to include new construction or undeveloped property, in addition to voluntary upgrades and repairs.\u00a0 Staff will consider this stakeholder\u2019s position through another regulatory action since many other stakeholders oppose changing performance requirements for undeveloped property.<\/p>\n<p>With the changes, costs will be significantly reduced, perhaps by 50% or more.\u00a0\u00a0The fast track amendments will undergo executive branch review and approval now.\u00a0 Following publication of the fast track amendments after executive branch approval, the regulations would take effect 15 days after the close of a 30-day comment period unless 10 or more persons object, or any member of the applicable standing committee of either house of the General Assembly or of the Joint Commission on Administrative Rules objects.\u00a0 In the event of a qualified objection, the fast track amendments would revert to the normal and routine regulatory adoption process.<\/p>\n<p>For more information, contact Dwayne Roadcap at Dwayne.Roadcap@vdh.virginia.gov or (804) 864-7458 or visit this<a href=\"http:\/\/townhall.virginia.gov\/L\/ViewStage.cfm?stageid=7791\"> link<\/a>.<\/p>\n<\/div>\n<hr \/>\n<span class=\"collapseomatic \" id=\"id6a147605c0666\"  tabindex=\"0\" title=\"&#8220;HB558\"    >&#8220;HB558<\/span><div id=\"target-id6a147605c0666\" class=\"collapseomatic_content \">\n<blockquote class=\"wp-embedded-content\" data-secret=\"H71eBo65Po\"><p><a href=\"https:\/\/www.vdh.virginia.gov\/environmental-health\/onsite-sewage-water-services-updated\/house-bill-558-plan-development\/\">House Bill 558: Plan Development<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute;
