The \u201cNotice and Description of Shellfish Area Condemnation Number 034-126, Wilton, Cobbs and Healy Creeks,\u201d effective 15 January 2025, is cancelled effective 15 February 2026.<\/p>\n<p>2. Condemned Shellfish Area Number 034-126, shown as Sections A through D, is hereby established effective 15 February 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled \u201cWilton, Cobbs, and Healy Creeks, Condemned Shellfish Area Number 034-126, 15 February 2026\u201d which is a part of this notice.<\/p>\n<p>3. Conditionally Approved Shellfish Area (seasonally closed status) Number 034-126, shown as Section M1, is hereby established, effective 15 February 2026, and shall remain in force annually thereafter for the period beginning the first day of April through the last day of October until rescinded. It shall be unlawful for any person, firm, or corporation to take shellfish from this area while in the closed status, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled \u201cWilton, Cobbs, and Healy Creeks, Condemned Shellfish Number 034-126, 15 February 2026\u201d which is part of this notice.<\/p>\n<p>4. Conditionally Approved Shellfish Area (closed status) Number 034-126, shown as Sections M2 through M5, is hereby established, effective 15 February 2026, and shall remain in force until rescinded. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas while in the closed status, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled \u201cWilton, Cobbs, and Healy Creeks, Condemned Shellfish Number 034-126, 15 February 2026\u201d which is part of this notice.<\/p>\n<p>5. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.<\/p>\n<p>BOUNDARIES OF CONDEMNED AREA NUMBER 034-126<\/p>\n<p>A. The condemned area shall include that portion of Wilton Creek and its tributaries upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b031'27.0\",-76\u00b025'05.1\") and map coordinate (37\u00b031'22.9\",-76\u00b025'00.7\").<\/p>\n<p>B. The condemned area shall include that portion of Cobbs Creek upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b031'24.2\",-76\u00b024'02.5\") and map coordinate (37\u00b031'25.8\",-76\u00b023'57.9\").<\/p>\n<p>C. The condemned area shall include all of the unnamed tributary of Wilton Creek upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b031'10.8\",-76\u00b025'06.1\") and map coordinate (37\u00b031'09.6\",-76\u00b025'06.1\").<\/p>\n<p>D. The condemned area shall include that portion of Healy Creek and its tributaries lying upstream of a line drawn between latitude\/longitude map coordinate (37\u00b032'31.2\",-76\u00b023'42.3\") and map coordinate (37\u00b032'29.8\",-76\u00b023'38.0\").<\/p>\n<p>M1. The conditionally approved (seasonally closed status) area shall include all of the unnamed tributary of Cobbs Creek upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b031'32.4\",-76\u00b024'10.0\") and map coordinate (37\u00b031'29.1\",-76\u00b024'07.3\").<\/p>\n<p>M2. The conditionally approved (closed status) area shall include that portion of Cobbs Creek inland of a line drawn between latitude \/ longitude map coordinate (37\u00b031'24.2\",-76\u00b024'02.5\"), map coordinate (37\u00b031'22.6\",-76\u00b023'57.3\"), map coordinate (37\u00b031'17.8\",-76\u00b023'58.5\"), and map coordinate (37\u00b031'18.1\",-76\u00b024'05.3\"); and is shown as part of Section B.<\/p>\n<p>M3. The conditionally approved (closed status) area shall include that portion of Healy Creek upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b032'36.6\",-76\u00b023'38.7\") and map coordinate (37\u00b032'36.1\",-76\u00b023'34.5\"), as well as downstream of a second line drawn between map coordinate (37\u00b032'38.3\",-76\u00b023'38.8\") and map coordinate (37\u00b032'40.0\",-76\u00b023'37.4\"), as well as downstream of a third line drawn between map coordinate (37\u00b032'40.4\",-76\u00b023'32.4\") and map coordinate (37\u00b032'36.9\",-76\u00b023'32.1\"); and is shown as part of Section D.<\/p>\n<p>M4. The conditionally approved (closed status) area shall include that portion of Wilton Creek inland of a line drawn between latitude \/ longitude map coordinate (37\u00b031'28.6\",-76\u00b025'00.8\"), map coordinate (37\u00b031'28.3\",-76\u00b024'59.4\"), map coordinate (37\u00b031'29.4\",-76\u00b024'57.9\"), and map coordinate ; (37\u00b031'33.6\",-76\u00b025'03.3\") and is shown as part of Section A.<\/p>\n<p>M5.
