NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
\nNUMBER 050-087, SKIMINO AND CARTER CREEKS<\/p>\n

EFFECTIVE 15 AUGUST 2023<\/p>\n

Pursuant to Title 28.2, Chapter 8, \u00a7\u00a7 28.2-803 through 28.2-808, \u00a7 32.1-20, and \u00a7 2.2-4002, B.16 of the Code of Virginia:<\/p>\n

1. The \u201cNotice and Description of Shellfish Area Condemnation Number 050-087, Skimino Creek,\u201d effective 15 August 2021, is cancelled effective 15 August 2023.<\/p>\n

2. Condemned Shellfish Area Number 050-087, shown as Sections A and B, is established, effective 15 August 2023. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled \u201cSkimino and Carter Creeks, Condemned Shellfish Area Number 050-087, 15 August 2023\u201d which is part of this notice.<\/p>\n

3. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.<\/p>\n

BOUNDARIES OF CONDEMNED AREA NUMBER 050-087<\/p>\n

A. The condemned area shall include that portion of the York River and all of Skimino Creek lying inland and upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b022'35.7\",-76\u00b040'30.4\") and map coordinate (37\u00b022'04.1\",-76\u00b039'44.0\").<\/p>\n

B. The condemned area shall include all of Carter Creek and its tributaries lying inland and upstream of a line drawn between latitude\/longitude map coordinate (37\u00b020'56.7\",-76\u00b039'18.7\") and map coordinate (37\u00b020'54.9\",-76\u00b039'18.5\").<\/p>\n<\/div>\n<\/div><\/div><\/div>
