The \u201cNotice and Description of Shellfish Area Condemnation Number 053-221, Chisman Creek,\u201d effective 15 June 2025, is cancelled effective 15 April 2026.<\/p>\n<p>2. Condemned Shellfish Area Number 053-221, shown as Sections A through G, is hereby established effective 15 April 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled \u201cChisman Creek, Condemned Shellfish Area Number 053-221, 15 April 2026\u201d which is part of this notice.<\/p>\n<p>3. Conditionally Approved Shellfish Area (seasonally closed status) Number 053-221, shown as Section M1, is hereby established effective 15 April 2026, and shall remain in force annually thereafter for the period beginning the first day of April through the last day of October until rescinded. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled \u201cChisman Creek, Condemned Shellfish Area Number 053-221, 15 April 2026\u201d which is part of this notice.<\/p>\n<p>4. Conditionally Approved Shellfish Area (closed status) Number 053-221, shown as Sections M2 through M4, is hereby established effective 15 April 2026. It shall be unlawful for any person, firm or corporation to take shellfish from these areas during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled \u201cChisman Creek, Condemned Shellfish Area Number 053-221, 15 April 2026\u201d which is part of this notice.<\/p>\n<p>5. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.<\/p>\n<p>BOUNDARIES OF CONDEMNED AREA NUMBER 053-221<\/p>\n<p>A. The condemned area shall include that portion of Chisman Creek and its tributaries upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b011'03.6\",-76\u00b025'00.1\") and map coordinate (37\u00b010'54.4\",-76\u00b025'00.2\").<\/p>\n<p>B. The condemned area shall include that portion of Boathouse Creek and its tributaries upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b010'38.0\",-76\u00b024'57.3\") and map coordinate (37\u00b010'35.3\",-76\u00b024'52.6\").<\/p>\n<p>C. The condemned area shall include all of the unnamed inlet of Chisman Creek inland of a line drawn between latitude \/ longitude map coordinate (37\u00b010'41.0\",-76\u00b023'52.6\") and map coordinate (37\u00b010'40.2\",-76\u00b023'51.2\").<\/p>\n<p>D. The condemned area shall include all of the unnamed inlet of Chisman Creek inland of a line drawn between latitude \/ longitude map coordinate (37\u00b010'37.2\",-76\u00b023'47.0\") and map coordinate (37\u00b010'35.6\",-76\u00b023'45.7\").<\/p>\n<p>E. The condemned area shall include all of the unnamed inlet of Chisman Creek inland of a line drawn between latitude \/ longitude map coordinate (37\u00b010'33.4\",-76\u00b023'41.7\") and map coordinate (37\u00b010'32.4\",-76\u00b023'40.2\").<\/p>\n<p>F. The condemned area shall include that portion of Chisman Creek inland and upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b011'04.7\",-76\u00b024'58.2\"), map coordinate (37\u00b010'59.5\",-76\u00b024'43.7\"), and map coordinate (37\u00b011'00.8\",-76\u00b024'40.9\").<\/p>\n<p>G. The condemned area shall include that portion of Cabin Creek upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b010'52.0\",-76\u00b023'59.4\") and map coordinate (37\u00b010'54.6\",-76\u00b023'54.5\").<\/p>\n<p>M1. The conditionally approved area (seasonally closed status) shall include that portion of Chisman Creek inland of a line drawn between latitude \/ longitude map coordinate (37\u00b010'57.7\",-76\u00b024'32.1\"), map coordinate (37\u00b010'55.6\",-76\u00b024'35.7\"), map coordinate (37\u00b010'52.2\",-76\u00b024'32.1\"), and map coordinate (37\u00b010'54.5\",-76\u00b024'28.2\").<\/p>\n<p>M2. The conditionally approved area (closed status) shall include that portion of Chisman Creek inland of a line drawn between latitude \/ longitude map coordinate (37\u00b011'07.0\",-76\u00b024'43.6\"), map coordinate (37\u00b011'05.3\",-76\u00b024'47.5\"), map coordinate (37\u00b010'59.5\",-76\u00b024'43.7\"), and map coordinate (37\u00b011'00.8\",-76\u00b024'40.9\"); but is shown in the report only.<\/p>\n<p>M3. The conditionally approved area (closed status) shall include that portion of Chisman Creek inland of a line drawn between latitude \/ longitude map coordinate (37\u00b010'59.2\",-76\u00b025'27.1\"), map coordinate (37\u00b011'01.4\",-76\u00b025'26.5\"), map coordinate (37\u00b011'03.8\",-76\u00b025'18.5\"), and map coordinate (37\u00b010'58.4\",-76\u00b025'15.8\"); but is shown in the report only.<\/p>\n<p>M4.
