
Right to breastfeed in public
According to § 32.1-370. Right to breastfeed, public breastfeeding is legally protected in Virginia. Mothers may breastfeed in public in any area they are legally present in.
Lactation at work
Employers are legally required to provide reasonable accommodations related to disability, pregnancy, childbirth or related medical conditions, and lactation when an employee requests accommodation according to § 2.2-3905. Nondiscrimination in employment; definitions; exceptions.
The Virginia Pregnant Workers Fairness Act (passed in 2020), requires employers to make reasonable accommodations for lactating employees, and give a space for them to privately express breast milk according to § 2.2-3905. Nondiscrimination in employment; definitions; exceptions.
Schools
According to the Code of Virginia § 2.2-3905. Nondiscrimination in employment; definitions; exceptions. Local school boards must adopt a policy to create a private, non-restroom space for students or employees at the school to take lactation breaks.
