NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 021U-132, WESTERN BRANCH CORROTOMAN RIVER
EFFECTIVE 15 DECEMBER 2025
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 2.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 021U-132, Western Branch Corrotoman River,” effective 15 November 2024, is cancelled effective 15 December 2025.
2. Condemned Shellfish Area Number 021U-132, shown as Section A through E, is hereby established effective 15 December 2025. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Western Branch Corrotoman River, Condemned Shellfish Area Number 021U-132, 15 December 2025” which is part of this notice.
3. Conditionally Approved Shellfish Area (Closed Status) Number 021U-132, shown as Sections M1 and M2, is hereby established effective 15 December 2025, and shall remain in force until rescinded. It shall be unlawful for any person, firm or corporation to take shellfish from these areas for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Western Branch Corrotoman River, Condemned Shellfish Area Number 021U-132, 15 December 2025” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 021U-132
A. The condemned area shall include that portion of the Western Branch Corrotoman River and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°43'56.6",-76°30'49.4") and map coordinate (37°43'57.6",-76°30'33.4").
B. The condemned area shall include all of Senior Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°43'37.1",-76°30'48.3") and map coordinate (37°43'33.8",-76°30'46.4").
C. The condemned area shall include that portion of John Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°43'02.3",-76°29'29.0") and map coordinate (37°43'00.7",-76°29'29.3").
D. The condemned area shall include all of Lowery Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°42'53.5",-76°29'58.7") and map coordinate (37°42'46.4",-76°29'58.2").
E. The condemned area shall include that portion of Davis Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°43'44.0",-76°30'27.0") and map coordinate (37°43'43.4",-76°30'24.5").
M1. The conditionally approved area (closed) area shall include that portion of the Western Branch Corrotoman River inland of a line drawn between latitude/longitude map coordinate (37°44'18.7",-76°31'04.7"), map coordinate (37°44'17.2",-76°31'03.3"), and map coordinate (37°44'15.5",-76°31'04.1"); and is shown as part of Section A.
M2. The conditionally approved area (closed) area shall include that portion of Senior Creek inland of a line drawn between latitude/longitude map coordinate (37°43'26.5",-76°30'53.8"), map coordinate (37°43'26.5",-76°30'54.6"), map coordinate (37°43'31.8",-76°30'54.3"), and map coordinate (37°43'31.7",-76°30'53.5"); and is shown as part of Section B.
