NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 025A-068, UPPER RAPPAHANNOCK RIVER
EFFECTIVE 15 APRIL 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 025A-068, Upper Rappahannock River,” effective 15 May 2025 is cancelled effective 15 April 2026.
2. Condemned Shellfish Area Number 025A-068, shown as Sections A, B, and C, is hereby established effective 15 April 2026. As to Section A, it shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Sections B and C, it shall be unlawful for any person, firm or corporation to take shellfish from these areas for any purpose. The boundaries of these areas are shown on the map titled “Upper Rappahannock River, Condemned Shellfish Area Number 025A-068, 15 April 2026” which is part of this notice.
3. Conditionally Approved Shellfish Area (Closed Status) Number 025A-068, shown as Sections M1 and M2, is hereby established effective 15 April 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Upper Rappahannock River, Condemned Shellfish Area Number 025A-068, 15 April 2026” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 025A-068
A. The condemned area shall include that portion of the Rappahannock River and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°53'18.3",-76°47'39.6"), map coordinate (37°53'47.8",-76°46'51.1"), and map coordinate (37°54'08.6",-76°46'20.0"); but excluding those areas defined as Sections B and C.
B. The condemned area shall include that portion of the Rappahannock River and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°55'50.3",-76°51'24.7"), map coordinate (37°55'53.9",-76°51'18.3"), and map coordinate (37°56'23.7",-76°50'31.8").
C. The condemned area shall include all of the Hoskins Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°55'21.1",-76°51'10.2") and map coordinate (37°55'17.0",-76°51'09.5").
M1. The conditionally approved area (closed status) shall include that portion of Rappahannock River inland of a line drawn between latitude / longitude map coordinate (37°55'47.4",-76°51'21.9"), map coordinate (37°55'47.5",-76°51'20.3"), map coordinate (37°55'42.2",-76°51'19.8"), and map coordinate (37°55'42.0",-76°51'23.0"); and is shown as part of Section A.
M2. The conditionally approved area (closed status) shall include all of the unnamed tributary of the Rappahannock River upstream and inland of a line drawn between latitude / longitude map coordinate (37°54'56.6",-76°50'01.2") and map coordinate (37°54'56.7",-76°50'00.9"); and is shown as part of Section A.
