NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 057-271, JAMES RIVER – NEWPORT NEWS
EFFECTIVE 15 AUGUST 2025
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 057-271, James River – Newport News,” effective 15 June 2021, is cancelled effective 15 August 2025.
2. Condemned Shellfish Area Number 057-271, shown as Sections A and B, is hereby established effective 15 August 2025. As to Section A, it shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Section B, it shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose. The boundaries of these areas are shown on the map titled “James River – Newport News, Condemned Shellfish Area Number 057-271, 15 August 2025” which is part of this notice.
3. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 057-271
A. The condemned area shall include that portion of the James River inland of a line between from latitude / longitude map coordinate (37°03'22.7",-76°31'09.0"), map coordinate (37°03'12.2",-76°31'25.4"), map coordinate (37°02'49.7",-76°30'47.7"), map coordinate (37°01'37.6",-76°28'18.0"), map coordinate (37°00'59.2",-76°27'46.7"), map coordinate (37°00'27.6",-76°27'45.9"), and map coordinate (37°00'46.9",-76°27'22.2").
B. The condemned area shall include that portion of the James River, and all of the Newport News Small Boat Harbor, inland of a line drawn between latitude / longitude map coordinate (37°00'46.9",-76°27'22.2"), map coordinate (37°00'27.6",-76°27'45.9"), map coordinate (36°59'16.9",-76°26'47.7"), map coordinate (36°58'11.0",-76°26'00.9"), map coordinate (36°57'59.3",-76°25'49.9"), map coordinate (36°57'44.9",-76°25'26.5"), map coordinate (36°56'52.8",-76°24'20.4"), map coordinate (36°57'17.1",-76°24'25.7"), and map coordinate (36°57'45.3",-76°24'40.9").
