NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 059-067, JAMES RIVER – OPPOSITE TRIBELL SHOAL CHANNEL
EFFECTIVE 15 JANUARY 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia.
1. The “Notice and Description of Shellfish Area Condemnation Number 059-067, James River - Opposite Tribell Shoal Channel,” effective 1 September 2010, is cancelled effective 15 January 2026.
2. Condemned Shellfish Area Number 059-067, shown as Sections A and B, is established, effective 15 January 2026. As to Section A, it shall be unlawful for any person, firm, or corporation to take shellfish from this area, for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Section B, it shall be unlawful for any person, firm or corporation to take shellfish from this area for any purpose. The boundaries of these areas are shown on the map titled “James River - Opposite Tribell Shoal Channel, Condemned Shellfish Area Number 059-067, 15 January 2026” which is part of this notice.
3. Conditionally Approved Shellfish Area (Closed Status) Number 059-067, shown as Section M1, is hereby established effective 15 January 2026, and shall remain in force until rescinded. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “James River - Opposite Tribell Shoal Channel, Condemned Shellfish Area Number 059-067, 15 January 2026,” which is a part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 059-067
A. The condemned area shall include that portion of the James River and its tributaries inland of a line drawn between latitude/longitude map coordinate (37°13'22.6",-76°40'16.9"), map coordinate (37°13'08.1",-76°40'16.5"), map coordinate (37°11'58.2",-76°38'34.0"), map coordinate (37°11'31.0",-76°38'05.1"), and map coordinate (37°11'22.7",-76°37'07.3").
B. The condemned area shall include that portion of the James River enclosed by a circle of 500 yards radius from latitude / longitude map coordinate (37°12'41.2",-76°38'59.0").
M1. The conditionally approved (closed status) area shall include that portion of the James River inland of a line drawn between latitude / longitude map coordinate (37°13'22.6",-76°39'52.0"), map coordinate (37°13'17.0",-76°39'52.0"), map coordinate (37°13'16.9",-76°39'37.7"), and map coordinate (37°13'23.5",-76°39'37.8"); and is shown as part of Section A.
