NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 066-272, HAMPTON ROADS SOUTH
EFFECTIVE 15 JUNE 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 066-272, Hampton Roads South,” effective 15 August 2025, is cancelled effective 15 June 2026.
2. Condemned Shellfish Area Number 066-272, shown as Sections A, B and C, is hereby established effective 15 June 2026. As to Section A, it shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Sections B and C, it shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose. The boundaries of these areas are shown on the map titled “Hampton Roads South, Condemned Shellfish Area Number 066-272, 15 June 2026” which is part of this notice.
3. Conditionally Approved Shellfish Area (Closed status) Number 066-272, shown as Sections M1, M2, and M3, is hereby established effective 15 June 2026. It shall be unlawful for any person, firm or corporation to take shellfish from these areas during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Hampton Roads South, Condemned Shellfish Area Number 001-088, 15 June 2026” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 066-272
A. The condemned area shall include that portion of Hampton Roads and its tributaries inland of a line drawn from longitude / latitude map coordinate (36°54'07.4",-76°25'24.2") and along the upstream edge of the Monitor-Merrimac Bridge-Tunnel to map coordinate (36°56'37.6",-76°24'12.1"); as well as south of second line drawn between map coordinate (36°56'52.8",-76°24'20.4"), map coordinate (36°57'50.6",-76°19'50.8"), and map coordinate (36°59'04.9",-76°18'17.9"); and west of a third line drawn from map coordinate (36°58'54.5",-76°18'08.3") and along the edge of the Hampton Roads Bridge-Tunnel to map coordinate (36°58'02.1",-76°17'50.0"); but north and west of a line drawn between latitude / longitude map coordinate (36°53'35.0",-76°20'20.3") and map coordinate (36°54'13.3",-76°19'33.8"). Section A excludes those areas defined as Sections B and C.
B. The condemned area shall include that portion of Hampton Roads enclosed by a circle of 250 yards radius around a point located at latitude / longitude map coordinate (36°55'55.3",-76°23'47.8").
C. The condemned area shall include that portion of Hampton Roads enclosed by a circle of 250 yards radius around a point located at latitude/longitude map coordinate (36°55'20.6",-76°20'08.6").
M1. The conditionally approved area (closed status) shall include that portion of Willoughby Bay inland of a line drawn between latitude / longitude map coordinate (36°57'46.8",-76°17'48.1"), map coordinate (36°57'41.7",-76°17'42.5") and map coordinate (36°57'49.2",-76°17'16.5"); but is shown in the report only.
M2. The conditionally approved area (closed status) shall include that portion of Willoughby Bay inland of a line drawn between latitude / longitude map coordinate (36°57'52.7",-76°16'37.6"), map coordinate (36°57'48.9",-76°16'34.7"), and map coordinate (36°57'48.4",-76°16'27.6"); but is shown in the report only.
M3. The conditionally approved area (closed status) shall include that portion of Willoughby Bay inland of a line drawn between latitude / longitude map coordinate (36°57'20.4",-76°18'42.8") map coordinate (36°57'24.4",-76°18'39.6"), and map coordinate (36°57'21.1",-76°18'27.2"); but is shown in the report only.
