NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 027-202, WEEKS AND HARRY GEORGE CREEKS
EFFECTIVE 15 JANUARY 2023
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 027-202, Weeks and Harry George Creeks,” effective 15 January 2021, is cancelled effective 15 January 2023.
2. Condemned Shellfish Area Number 027-202, shown as Sections A and B, is hereby established effective 15 January 2023. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Weeks and Harry George Creeks, Condemned Shellfish Area Number 027-202, 15 January 2023” which is a part of this notice.
3. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 027-202
A. The condemned area shall include that portion of Weeks Creek and its tributaries upstream of a line drawn from latitude / longitude coordinate (37°41'48.0",-76°35'55.9") to map coordinate (37°41'45.4",-76°35'49.2").
B. The condemned area shall include all of Harry George Creek and its tributaries upstream and inland of a line drawn from latitude / longitude map coordinate (37°43'08.8",-76°35'57.1") and map coordinate (37°43'07.0",-76°35'56.3"), as well as upstream and inland of a second line drawn from map coordinate (37°43'05.9",-76°35'55.7") to map coordinate (37°43'01.2",-76°35'51.6"), as well as upstream and inland of a third line drawn from map coordinate (37°42'58.1",-76°35'49.2") to map coordinate (37°42'50.2",-76°35'46.8").
