NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 028-177, ROBINSON CREEK
EFFECTIVE 15 MARCH 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia.
1. The “Notice and Description of Shellfish Area Condemnation Number 028-177, Robinson Creek” effective 15 February 2025, is cancelled effective 15 March 2026.
2. Condemned Shellfish Area Number 028-177, shown as Sections A through C is hereby established effective 15 March 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Robinson Creek, Condemned Shellfish Area Number 028-177, 15 March 2026” which is part of this notice.
3. The Conditionally Approved Shellfish Area (Closed Status) Number 028-177, shown as Sections M1 through M3, is hereby established effective 15 March 2026. It shall be unlawful for any person, firm or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Robinson Creek, Condemned Shellfish Area Number 028-177, 15 March 2026” which is part of this notice.
4. Seasonally Condemned Shellfish Area Number 028-177, shown as Sections S218, is hereby established effective 15 March 2026, and shall remain in force annually thereafter for the period beginning the first day of April through the last day of October until rescinded. It shall be unlawful for any person, firm, or corporation to take shellfish from this area during such period for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “Robinson Creek, Condemned Shellfish Area Number 028-177, 15 March 2026” which is part of this notice.
5. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 028-177
A. The condemned area shall include that portion of Robinson Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°39'15.2",-76°34'58.4") and map coordinate (37°39'17.8",-76°34'45.0").
B. The condemned area shall include that portion of Perkins Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°38'50.5",-76°34'36.6") and map coordinate (37°38'49.5",-76°34'36.4").
C. The condemned area shall include all of the unnamed tributary of Robinson Creek upstream of a line drawn between latitude / longitude map coordinate (37°39'03.2",-76°34'50.8") and map coordinate (37°39'03.0",-76°34'49.7").
M1. The conditionally approved area (closed status) shall include that portion of Robinson Creek lying inland of a line drawn from latitude / longitude map coordinate (37°39'25.1",-76°34'46.3"), map coordinate (37°39'24.5",-76°34'50.1"), map coordinate (37°39'17.3",-76°34'48.8"), and map coordinate (37°39'17.8",-76°34'45.0"); and is included in the area defined as Section A.
M2. The conditionally approved area (closed status) shall include that portion of an unnamed tributary of Robinson Creek lying upstream of a line drawn from latitude / longitude map coordinate (37°39'19.1",-76°35'29.4") and map coordinate (37°39'17.8",-76°35'26.7"), as well as downstream of a second line drawn from map coordinate (37°39'14.8",-76°35'34.0") and map coordinate (37°39'13.0",-76°35'31.9"); and is included in the area defined as Section A.
M3. The conditionally approved area (closed status) shall include that portion of Robinson Creek and its tributaries lying upstream and inland of a line drawn from latitude / longitude map coordinate (37°39'19.9",-76°35'16.5"), map coordinate (37°39'23.1",-76°35'10.5"), map coordinate (37°39'24.5",-76°34'57.1"), and map coordinate (37°39'15.2",-76°34'58.4"); and is included in the area defined as Section A.
S218. The seasonally condemned area shall include that portion of Robinson Creek upstream of a line drawn between latitude / longitude map coordinate (37°39'18.5",-76°34'40.4") and map coordinate (37°39'04.5",-76°34'43.6"), but excludes the areas defined as Sections A and C.
