NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 029-042, URBANNA CREEK
EFFECTIVE 15 MARCH 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 029-042, Urbanna Creek,” effective 14 February 2025, is cancelled effective 15 March 2026.
2. Condemned Shellfish Area Number 029-042, shown as Sections A and B, is hereby established effective 15 March 2026. As to Section A, it shall be unlawful for any person, firm, or corporation to take shellfish from this area, for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Section B, it shall be unlawful for any person, firm or corporation to take shellfish from this area, for any purpose. The boundaries of these areas are shown on the map titled “Urbanna Creek, Condemned Shellfish Area Number 029-042, 15 March 2026” which is part of this notice.
3. The Conditionally Approved Shellfish Area (Closed Status) Number 029-042, shown as Sections M1 and M2, is hereby established effective 15 March 2026. It shall be unlawful for any person, firm or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Urbanna Creek, Condemned Shellfish Area Number 029-042, 15 March 2026” which is part of this notice.
4. The Conditionally Approved Shellfish Area (Open Status) Number 029-042, shown as Sections M3 and M4, is hereby established effective 15 March 2026. It shall be unlawful for any person, firm or corporation to take shellfish from these areas during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Urbanna Creek, Condemned Shellfish Area Number 029-042, 15 March 2026” which is part of this notice.
5. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 029-042
A. The condemned area shall include all of that portion of Urbanna Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°38'29.7",-76°34'03.1") and map coordinate (37°38'22.5",-76°34'04.9"); but excluding the area defined as Section B.
B. The condemned area shall include all of that portion of Urbanna Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°37'33.0",-76°34'45.1") and map coordinate (37°37'27.2",-76°34'36.5").
M1. The conditionally approved area (closed status) shall include that portion of Urbanna Creek inland of a line drawn between latitude / longitude map coordinate (37°38'23.9",-76°34'16.2") and map coordinate (37°38'29.1",-76°34'06.4"); and is included in the area defined as Section A.
M2. The conditionally approved area (closed status) shall include that portion of Urbanna Creek upstream of a line drawn between latitude / longitude map coordinate (37°38'18.8",-76°34'14.2"), map coordinate (37°38'19.1",-76°34'12.7"), and map coordinate (37°38'07.2",-76°34'06.6"), as well as downstream of a second line drawn between map coordinate (37°37'59.8",-76°34'22.3") and map coordinate (37°37'51.3",-76°34'19.3"); and is included in the area defined as Section A.
M3. The conditionally approved area (open status) shall include that portion of the Rappahannock River inland of a line drawn between latitude / longitude map coordinate (37°37'32.0",-76°33'04.2"), map coordinate (37°37'33.0",-76°33'01.6"), map coordinate (37°37'29.8",-76°32'59.7"), and map coordinate (37°37'28.4",-76°33'03.1"); but is referenced only in the closure report and not the map.
M4. The conditionally approved area (open status) shall include that portion of the Rappahannock River inland of a line drawn between latitude / longitude map coordinate (37°37'12.3",-76°32'49.9"), map coordinate (37°37'14.9",-76°32'46.8"), map coordinate (37°37'12.9",-76°32'44.2"), and map coordinate (37°37'10.1",-76°32'47.1"); but is referenced only in the closure report and not the map.
