NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 034-208, JACKSON, MOORE, AND CORES CREEKS
EFFECTIVE 15 FEBRUARY 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 034-208, Jackson, Moore and Healy Creeks,” effective 15 January 2026, is cancelled effective 15 February 2026.
2. Condemned Shellfish Area Number 034-208, shown as Sections A through E, is hereby established effective 15 February 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Jackson, Moore, and Cores Creeks, Condemned Shellfish Area Number 034-208, 15 February 2026” which is a part of this notice.
3. Conditionally Approved Shellfish Area (closed status) Number 034-208, shown as Sections M1 through M10, is hereby established, effective 15 February 2026, and shall remain in force until rescinded. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Jackson, Moore, and Cores Creeks, Condemned Shellfish Number 034-208, 15 February 2026” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 034-208
A. The condemned area shall include that portion of the western prong of Jackson Creek upstream of a line drawn between latitude / longitude map coordinate (37°32'49.6",-76°20'19.8") and map coordinate (37°32'52.4",-76°20'17.0").
B. The condemned area shall include all of Porpoise Cove lying upstream of a line drawn between latitude/longitude map coordinate (37°32'13.4",-76°21'11.1") and map coordinate (37°32'12.5",-76°21'10.1").
C. The condemned area shall include that portion of Moore Creek and its tributaries lying upstream of a line drawn between latitude/longitude map coordinate (37°32'31.1",-76°21'34.2") and map coordinate (37°32'30.7",-76°21'28.8").
D. The condemned area shall include all of Cores Creek and its tributaries lying upstream of a line drawn between latitude/longitude map coordinate (37°32'22.4",-76°22'19.5") and map coordinate (37°32'22.3",-76°22'18.0").
E. The condemned area shall include all of the unnamed cove of Jackson Creek upstream of a line drawn between latitude / longitude map coordinate (37°32'40.0",-76°19'48.0") and map coordinate (37°32'40.0",-76°19'41.3").
M1. The conditionally approved (closed status) area shall include that portion of Fishing Bay inland of a line drawn between latitude / longitude map coordinate (37°32'19.8",-76°20'23.1") and map coordinate (37°32'33.4",-76°20'07.0").
M2. The conditionally approved (closed status) area shall include that portion of Fishing Bay inland of a line drawn between latitude / longitude map coordinate (37°32'31.3",-76°19'59.3"), map coordinate (37°32'29.4",-76°20'00.8"), map coordinate (37°32'27.8",-76°19'58.3"), and map coordinate (37°32'29.9",-76°19'56.2").
M3. The conditionally approved (closed status) area shall include that portion of the Piankatank River inland of a line drawn between latitude / longitude map coordinate (37°31'52.0",-76°19'51.0"), map coordinate (37°31'52.8",-76°20'02.7"), map coordinate (37°31'50.8",-76°20'03.0"), and map coordinate (37°31'49.8",-76°19'51.2").
M4. The conditionally approved (closed status) area shall include all of the unnamed tributary of the western prong of Jackson Creek upstream of a line drawn between latitude / longitude map coordinate (37°32'45.0",-76°20'21.2") and map coordinate (37°32'42.2",-76°20'16.7").
M5. The conditionally approved (closed status) area shall include that portion of the western prong of Jackson Creek inland of a line drawn between latitude / longitude map coordinate (37°32'37.7",-76°20'05.2"), map coordinate (37°32'40.8",-76°20'04.9"), map coordinate (37°32'42.6",-76°19'51.4"), and map coordinate (37°32'40.6",-76°19'49.2").
M6. The conditionally approved (closed status) area shall include that portion of the middle prong of Jackson Creek inland of a line drawn between latitude / longitude map coordinate (37°33'00.4",-76°19'54.3"), map coordinate (37°32'55.9",-76°19'52.2"), map coordinate (37°32'50.3",-76°19'41.3"), and map coordinate (37°32'49.7",-76°19'32.8").
M7. The conditionally approved (closed status) area shall include that portion of the eastern prong of Jackson Creek inland of a line drawn between latitude / longitude map coordinate (37°32'53.1",-76°19'26.2"), map coordinate (37°32'50.7",-76°19'22.6"), map coordinate (37°32'53.6",-76°19'19.6"), map coordinate (37°32'56.4",-76°19'25.2"), and map coordinate (37°32'55.6",-76°19'25.7").
M8. The conditionally approved (closed status) area shall include that portion of the eastern prong of Jackson Creek inland of a line drawn between latitude / longitude map coordinate (37°33'01.5",-76°19'20.0"), map coordinate (37°33'06.8",-76°19'19.7"), map coordinate (37°33'09.7",-76°19'22.5"), and map coordinate (37°33'09.0",-76°19'23.8").
M9. The conditionally approved (closed status) area shall include that portion of Porpoise Cove upstream of a line drawn between latitude / longitude map coordinate (37°32'14.8",-76°21'08.0") and map coordinate (37°32'16.7",-76°21'07.1"), as well as downstream of second line drawn between map coordinate (37°32'17.6",-76°21'03.6") and map coordinate (37°32'15.5",-76°21'00.0"); and is shown as part of Section B.
M10. The conditionally approved (closed status) area shall include that portion of the western prong of Jackson Creek upstream oa a line drawn between latitude / longitude map coordinate (37°32'49.6",-76°20'19.8") and map coordinate (37°32'52.4",-76°20'17.0"), as well as downstream of a second line drawn between map coordinate (37°32'54.6",-76°20'27.5") and map coordinate (37°32'55.1",-76°20'24.4"); and is shown as part of Section A.
