NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 042-157, NORTH RIVER
EFFECTIVE 15 AUGUST 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia.
1. The “Notice and Description of Shellfish Area Condemnation Number 042-157, North River,” effective 15 September 2025, is cancelled effective 15 August 2026.
2. Condemned Shellfish Area Number 042-157, shown as Sections A through I, is established effective 15 August 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “North River, Condemned Shellfish Area Number 042-157, 15 August 2026” which is part of this notice.
3. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 042-157
A. The condemned area shall include that portion of the North River and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°26'20.6",-76°26'48.6") and map coordinate (37°26'20.7",-76°26'30.5").
B. The condemned area shall include all of the unnamed tributary of the North River upstream of a line drawn between latitude / longitude map coordinate (37°25'15.6",-76°25'50.4") and map coordinate (37°25'15.8",-76°25'45.0").
C. The condemned area shall include all of Back Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°25'08.2",-76°27'09.5") and map coordinate (37°25'04.6",-76°27'06.5").
D. The condemned area shall include all of Elmington Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°25'20.2",-76°27'10.5") and map coordinate (37°25'16.0",-76°27'11.4").
E. The condemned area shall include all of Toddsbury Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°25'57.1",-76°27'14.5") and map coordinate (37°25'54.8",-76°27'14.3").
F. The condemned area shall include all of the unnamed tributary of the North River upstream of a line drawn between latitude / longitude map coordinate (37°24'34.5",-76°25'15.1") and map coordinate (37°24'33.2",-76°25'15.0").
G. The condemned area shall include all of Belleville Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°24'35.5",-76°26'09.3") and map coordinate (37°24'32.2",-76°26'06.1").
H. The condemned area shall include all of the unnamed tributary of the North River upstream of a line drawn between latitude / longitude map coordinate (37°25'23.1",-76°26'26.9") and map coordinate (37°25'22.7",-76°26'26.6").
I. The condemned area shall include all of the unnamed tributary of the North River upstream of a line drawn between latitude / longitude map coordinate (37°25'19.1",-76°25'20.4") and map coordinate (37°25'19.2",-76°25'19.9").
