NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 048-128, MORRIS BAY AND VICINITY
EFFECTIVE 15 AUGUST 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia.
1. The “Notice and Description of Shellfish Area Condemnation Number 048-128, Morris Bay and Vicinity,” effective 15 September 2025, is cancelled effective 15 August 2026.
2. Condemned Shellfish Area Number 048-128, shown as Sections A through E, is hereby established, effective 15 August 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Morris Bay and Vicinity, Condemned Shellfish Area Number 048-128, 15 August 2026” which is part of this notice.
3. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 048-128
A. The condemned area shall include that portion of Morris Bay and all of Poropotank Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°26'45.1",-76°41'43.5") and map coordinate (37°27'06.8",-76°41'35.3").
B. The condemned area shall include that portion of Adams Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°25'46.0",-76°41'05.2") and map coordinate (37°25'45.0",-76°41'08.5").
C. The condemned area shall include that portion of Purtan Bay and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°24'46.7",-76°39'53.1") and map coordinate (37°24'43.8",-76°39'30.3").
D. The condemned area shall include all of Bland Creek and its tributaries inland and upstream of a line drawn between latitude / longitude map coordinate (37°24'24.8",-76°39'23.7"), map coordinate (37°24'06.0",-76°39'42.2"), and map coordinate (37°23'54.9",-76°39'19.9").
E. The condemned area shall include all of Guthries Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°27'05.4",-76°42'03.6") and map coordinate (37°27'06.9",-76°41'59.7").
