NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 051-035, QUEEN, KING AND FELGATES CREEKS
EFFECTIVE 15 SEPTEMBER 2025
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 051-035, Queen, King and Felgates Creek,” effective 14 August 2021, is cancelled effective 15 September 2025.
2. Condemned Shellfish Area Number 051-035, shown as Sections A through D, is established, effective 15 September 2025. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Queen, King and Felgates Creeks, Condemned Shellfish Area Number 051-035, 15 September 2025” which is part of this notice.
3. Conditionally Approved Shellfish Area (seasonally closed status) Number 051-035, shown as Section M1, is hereby established effective 15 September 2025. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “Queen, King and Felgates Creeks, Condemned Shellfish Area Number 051-035, 15 September 2025” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 051-035
A. The condemned area shall include that portion of Queen Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°18'04.8",-76°37'20.0") and map coordinate (37°17'56.8",-76°37'15.4").
B. The condemned area shall include that portion of the York River encompassing the Cheatham Annex Naval pier and is inland of a line drawn from latitude / longitude map coordinate (37°17'11.6",-76°35'28.0"), to map coordinate (37°17'42.6",-76°35'16.3"), to map coordinate (37°17'20.2",-76°34'45.3"), and on to map coordinate (37°17'02.6",-76°35'09.9").
C. The condemned area shall include that portion of King Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°16'51.1",-76°35'21.5") and map coordinate (37°16'40.7",-76°35'19.6").
D. The condemned area shall include all of Felgates Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°16'30.6",-76°35'10.5") and map coordinate (37°16'28.2",-76°35'02.0").
M1. The conditionally approved area (closed status) shall include that portion of Queen Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°17'49.9",-76°38'48.7") and map coordinate (37°17'52.5",-76°38'51.4"), as well as downstream of a second line drawn between map coordinate (37°17'56.3",-76°39'08.7") and map coordinate (37°17'57.4",-76°39'05.9"); but is shown in the report only.
