NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 056-007, HAMPTON ROADS NORTH
EFFECTIVE 15 AUGUST 2025
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 056-007, Hampton Roads North,” effective 15 June 2021, is cancelled effective 15 August 2025.
2. Condemned Shellfish Area Number 056-007, shown as Section A, is hereby established effective 15 August 2025. As to Section A, it shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “Hampton Roads North, Condemned Shellfish Area Number 056-007, 15 August 2025” which is part of this notice.
3. Conditionally Approved (closed status) Shellfish Area Number 056-007, shown as Sections M1 through M4, is established 15 August 2025. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Hampton Roads North, Condemned Shellfish Area Number 056-007, 15 August 2025,” which is a part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 056-007
A. The condemned area shall include that portion of Hampton Roads and its tributaries west of a line drawn between longitude / latitude map coordinate (37°00'04.8",-76°18'16.3") and map coordinate (36°59'13.2",-76°18'09.1"): as well as north of a second line drawn between map coordinate (36°59'04.9",-76°18'17.9"), map coordinate (36°57'50.6",-76°19'50.8"), map coordinate (36°56'53.5",-76°24'19.6"), map coordinate (36°57'17.1",-76°24'25.7"), and map coordinate (36°57'45.3",-76°24'40.9").
M1. The conditionally approved area (closed status) shall include all of the Hampton River upstream of a line drawn between latitude/longitude map coordinate (37°00'39.8",-76°20'41.2"), and map coordinate (37°00'46.5",-76°19'53.0").
M2. The conditionally approved area (closed status) shall include that portion of Hampton Roads inland of a line drawn between latitude/longitude map coordinate (37°00'06.7",-76°18'54.1"), map coordinate (37°00'07.2",-76°19'00.0"), and map coordinate (37°00'42.6",-76°18'57.4").
M3. The conditionally approved area (closed status) shall include that portion of Hampton Roads at the mouth of Mill Creek inland of a line drawn between latitude/longitude map coordinate (37°00'47.0",-76°19'10.1"), map coordinate (37°00'43.7",-76°19'07.4"), map coordinate (37°00'47.4",-76°19'01.3"), and map coordinate (37°00'50.6",-76°19'05.2").
M4. The conditionally approved area (closed status) shall include that portion of Mill Creek inland of a line drawn between latitude/longitude map coordinate (37°01'26.9",-76°18'39.5"), map coordinate (37°01'25.2",-76°18'37.5"), map coordinate (37°01'27.7",-76°18'34.1"), and map coordinate (37°01'29.3",-76°18'35.9").
