NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 058-034, WARWICK AND JAMES RIVERS
EFFECTIVE 15 JANUARY 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The "Notice and Description of Shellfish Area Condemnation Number 058-034, Warwick and James Rivers", effective 18 August 2025, is cancelled effective 15 January 2026.
2. Condemned Shellfish Area Number 058-034, shown as Sections A and B, is established effective 15 January 2026. As to Section A, it shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Section B, it shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose. The boundaries of these areas are shown on the map titled “Warwick and James Rivers, Condemned Shellfish Area Number 058-034, 15 January 2026” which is part of this notice.
3. Conditionally Approved Shellfish Area (Closed Status) Number 058-034, shown as Section M1, is hereby established effective 15 January 2026, and shall remain in force until rescinded. It shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose while in the closed status, except by permit granted by Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “Warwick and James Rivers, Condemned Shellfish Area Number 058-034, 15 January 2026” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration of revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 058-034
A. The condemned area shall include all of the Warwick River and that portion of the James River inland and upstream of a line drawn between latitude / longitude map coordinate (37°04'38.7",-76°33'39.1"), map coordinate (37°04'31.2",-76°33'44.0"), map coordinate (37°03'36.1",-76°32'05.8"), map coordinate (37°03'12.2",-76°31'25.4") and map coordinate (37°03'22.7",-76°31'09.0"); but excludes the area defined as Section B.
B. The condemned area shall include that portion of the Warwick River inside of boundary line defined by latitude / longitude map coordinate (37°04'13.3",-76°32'35.6"), map coordinate (37°04'51.6",-76°32'33.4"), map coordinate (37°04'48.8",-76°31'45.4"), and navigational aid R"4" located at map coordinate (37°04'00.8",-76°32'09.3").
M1. The conditionally approved area (closed status) shall that portion of Deep Creek upstream of a line drawn between latitude / longitude map coordinate (37°04'53.0",-76°31'37.7") and map coordinate (37°04'50.8",-76°31'33.0"), as well as downstream of a second line drawn between map coordinate (37°05'17.4",-76°31'24.0") and map coordinate (37°05'16.8",-76°31'18.3"); and is shown as part of Section A.
