NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 061-064, PAGAN RIVER
EFFECTIVE 15 JUNE 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia.
1. The “Notice and Description of Shellfish Area Condemnation Number 061-064, Pagan River and Jones Creek,” effective 15 July 2025, is cancelled effective 15 June 2026.
2. Condemned Shellfish Area Number 061-064, shown as Sections A through D, is hereby established effective 15 June 2026. As to Sections A and B, it shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Sections C and D, it shall be unlawful for any person, firm, or corporation to take shellfish from these areas, for any purpose. The boundaries of these areas are shown on the map titled “Pagan River, Condemned Shellfish Area Number 061-064, 15 June 2026” which is part of this notice.
3. Conditionally Approved Shellfish Area (Closed Status) Number 061-064, shown as Sections M1 through M5, is hereby established effective 15 June 2026. It shall be unlawful for any person, firm or corporation to take shellfish from these areas during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Pagan River, Condemned Shellfish Area Number 061-064, 15 June 2026” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 061-064
A. The condemned area shall include that portion of the Pagan River and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°00'39.5",-76°34'51.4") and map coordinate (37°00'13.6",-76°33'53.3"); but excludes the areas defined as Sections B, C, and D.
B. The condemned area shall include that portion of Jones Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (36°57'37.4",-76°34'12.1") and map coordinate (36°57'36.0",-76°34'11.3").
C. The condemned area shall include all of Titus Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (36°58'24.8",-76°33'47.6") and map coordinate (36°58'27.2",-76°33'46.9").
D. The condemned area shall include that portion of Jones Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (36°57'49.1",-76°34'07.0") and map coordinate (36°57'49.6",-76°34'05.2"); but excludes the area defined as Section B.
M1. The conditionally approved area (closed status) shall include that portion of Jones Creek upstream of a line drawn between latitude / longitude map coordinate (36°59'51.9",-76°34'06.0") and map coordinate (36°59'55.3",-76°34'03.4"); as well as downstream of a second line drawn between map coordinate (36°59'46.2",-76°33'54.4") and map coordinate (36°59'48.5",-76°33'51.2"); but is shown in the report only.
M2. The conditionally approved area (closed status) shall include that portion of Jones Creek upstream of a line drawn between latitude / longitude map coordinate (36°59'42.9",-76°33'50.5") and map coordinate (36°59'44.0",-76°33'47.1"); as well as downstream of a second line drawn between map coordinate (36°59'39.4",-76°33'46.0") and map coordinate (36°59'39.4",-76°33'46.0"); but is shown in the report only.
M3. The conditionally approved area (closed status) shall include that portion of the Pagan River inland of a line drawn between latitude / longitude map coordinate (36°59'45.6",-76°35'03.5"), map coordinate (36°59'48.1",-76°35'03.2"), map coordinate (36°59'47.3",-76°34'51.2"), and map coordinate (36°59'43.7",-76°34'50.9"); but is shown in the report only.
M4. The conditionally approved area (closed status) shall include that portion of the Pagan River upstream of a line drawn between latitude / longitude map coordinate (36°59'00.6",-76°37'15.8") and map coordinate (36°58'57.9",-76°37'08.6"); and downstream of a second line drawn between map coordinate (36°58'57.7",-76°37'29.0") and map coordinate (36°59'01.1",-76°37'28.4"); as well as downstream of a third line drawn between map coordinae (36°58'53.7",-76°37'18.1") and map coordinate (36°58'53.7",-76°37'12.8");but is shown in the report only.
M5. The conditionally approved area (closed status) shall include that portion of the Pagan River upstream of a line drawn between latitude / longitude map coordinate (36°58'57.8",-76°37'40.6") and map coordinate (36°58'59.9",-76°37'41.2"); as well as downstream of a second line drawn between map coordinate (36°59'01.6",-76°37'47.7") and map coordinate (36°59'01.9",-76°37'44.8"); but is shown in the report only.
