NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 071-227, LITTLE NECK CREEK
EFFECTIVE 15 MARCH 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 071-227, Little Neck Creek,” effective 15 March 2025, is canceled effective 15 March 2026.
2. Condemned Shellfish Area Number 071-227, shown as Sections A through G, is hereby established effective 15 March 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Little Neck Creek, Condemned Shellfish Area Number 071-227, 15 March 2026” which is part of this notice.
3. The Conditionally Approved Shellfish Area (closed status) Number 071-227, shown as Sections M1 and M2, is hereby established effective 15 March 2026. It shall be unlawful for any person, firm or corporation to take shellfish from these areas during such period for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Little Neck Creek, Condemned Shellfish Area Number 071-227, 15 March 2026” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 071-227
A. The condemned area shall include that portion of Little Neck Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (36°51'58.0",-76°00'01.3") and map coordinate (36°52'01.6",-75°59'50.5").
B. The condemned area shall include that portion of Little Neck Creek inland of a line drawn between latitude / longitude map coordinate (36°52'11.9",-76°00'26.7") and map coordinate (36°52'08.5",-76°00'07.5").
C. The condemned area shall include all of the unnamed tributary of Little Neck Creek upstream of a line drawn between latitude/longitude map coordinate (36°52'16.9",-76°00'10.8") and map coordinate (36°52'16.6",-76°00'04.2").
D. The condemned area shall include all of the unnamed tributary of Little Neck Creek upstream of a line drawn between latitude/longitude map coordinate (36°52'16.6",-76°00'04.2") and map coordinate (36°52'16.1",-75°59'57.0").
E. The condemned area shall include all of the unnamed tributary of Little Neck Creek upstream of a line drawn between latitude/longitude map coordinate (36°52'08.1",-75°59'54.1") and map coordinate (36°52'05.3",-75°59'53.2").
F. The condemned area shall include all of the unnamed tributary of Little Neck Creek upstream of a line drawn between latitude/longitude map coordinate (36°52'04.8",-75°59'52.8") and map coordinate (36°52'01.6",-75°59'50.5").
G. The condemned area shall include all of the unnamed tributary of Little Neck Creek upstream of a line drawn between latitude/longitude map coordinate (36°52'03.8",-76°00'02.1") and map coordinate (36°51'58.0",-76°00'01.3").
M1. The conditionally approved area (closed status) shall include that portion of Little Neck Creek lying upstream of a line drawn from latitude / longitude map coordinate (36°51'34.3",-75°59'33.3") and map coordinate (36°51'39.8",-75°59'28.0"); and is included in the area defined as Section A.
M2. The conditionally approved area (closed status) shall include that portion of Little Neck Creek lying inland of a line drawn from latitude / longitude map coordinate (36°52'06.7",-76°00'26.7"), map coordinate (36°52'11.1",-76°00'22.3") , and map coordinate (36°52'08.4",-76°00'11.1"); and is included in the area defined as Section B.
