NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 079-112, CHESCONESSEX CREEK AND VICINITY
EFFECTIVE 15 JUNE 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 079-112, Chesconessex Creek and Vicinity,” effective 15 August 2025, is cancelled effective 15 June 2026.
2. Condemned Shellfish Area Number 079-112, shown as Sections A, B, and C, is hereby established effective 15 June 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the maps titled “Chesconessex Creek and Vicinity, Condemned Shellfish Area Number 079-112, 15 June 2026” which is part of this notice.
3. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 079-112
A. The condemned area shall include that portion of Chesconessex Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°44'32.8",-75°45'38.7") and map coordinate (37°44'27.2",-75°45'39.9").
B. The condemned area shall include all of the unnamed inlet of Pompco and Chesconessex Creeks, found near Factory Point, upstream of a line drawn between latitude / longitude map coordinate (37°45'47.3",-75°46'19.3") and map coordinate (37°45'48.4",-75°46'16.5").
C. The condemned area shall include that portion of the marsh inlet between unnamed inlet of Pompco and Chesconessex Creeks inland of a line drawn between latitude / longitude map coordinate (37°46'05.4",-75°47'40.7") and map coordinate (37°46'04.8",-75°47'37.5"); as well as inland of a second line between map coordinate (37°45'59.8",-75°47'31.2") and map coordinate (37°45'59.8",-75°47'27.0"); as well as inland of a third line between (37°46'09.4",-75°47'32.6") and map coordinate (37°46'04.1",-75°47'23.5").
