NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 086-136, HUNGARS AND MATTAWOMAN CREEKS
EFFECTIVE 15 SEPTEMBER 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 086-136, Hungars and Mattawoman Creeks,” effective 15 October 2023, is cancelled effective 15 September 2026.
2. Condemned Shellfish Area Number 086-136, shown as Sections A through E, is hereby established effective 15 September 2026. As to Sections A through D, it shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Section E, it shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose. The boundaries of these areas are shown on the map titled “Hungars and Mattawoman Creeks, Condemned Shellfish Area Number 086-136, 15 September 2026” which is part of this notice.
3. Conditionally Approved Shellfish Area (open status) Number 086-136, shown as Sections M1 and M2, is hereby established effective 15 September 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Brown’s Point – Hungars and Mattawoman Creeks, Condemned Shellfish Area Number 086-136, 15 September 2026” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 086-136
A. The condemned area shall include that portion of Hungars Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°26'04.2",-75°56'32.7") and map coordinate (37°25'58.9",-75°56'28.8").
B. The condemned area shall include that portion of Jacobus Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°25'13.0",-75°56'29.2") and map coordinate (37°25'05.9",-75°56'26.0"); but excludes the area defined as Section E.
C. The condemned area shall include all of the unnamed tributary of Mattawoman Creek upstream of a line drawn between latitude / longitude map coordinate (37°23'19.6",-75°56'52.2") and map coordinate (37°23'19.4",-75°56'45.4").
D. The condemned area shall include that portion of Mattawoman Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°23'08.6",-75°56'48.3") and map coordinate (37°23'09.5",-75°56'41.8").
E. The condemned area shall include that portion of Jacobus Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°25'04.0',-75°56'04.7") and map coordinate (37°24'59.l",-75°56'04.4").
M1. The conditionally approved area (open status) shall include that portion of Hungars Creek inland of a line drawn between latitude / longitude map coordinate (37°25'05.1",-75°58'15.4"), map coordinate (37°25'03.1",-75°58'15.8"), map coordinate (37°25'01.3",-75°58'08.9"), and map coordinate (37°25'02.4",-75°58'08.8"): and is shown only on the report.
M2. The conditionally approved area (open status) shall include that portion of Hungars Creek inland of a line drawn between latitude / longitude map coordinate (37°25'54.9",-75°56'57.4"), map coordinate (37°25'53.1",-75°56'53.4"), map coordinate (37°25'51.0",-75°56'53.9"), and map coordinate (37°25'50.8",-75°56'57.5"): and is shown only on the report.
