What should my agency do in event of identifying drug diversion activity?

Virginia EMS Regulations 12VAC5-31-520.D requires an EMS Agency to notify the Office of Emergency Medical Services in writing of any diversion of (i.e., loss or theft) or tampering with any controlled substances, drug delivery devices, or other regulated medical devices from an agency, facility or vehicle. Notification shall be made within 15 days of the discovery of the occurrence.

Do I need to be submit a background check and fingerprints to work or volunteer in EMS?

All members joining a licensed EMS agency must submit to a finger print based criminal history background check and be approved by the OEMS for both affiliation and certification. This includes non EMS certified members such as drivers. There is NOT a grandfather clause to this regulatory change. Affiliated non-certified members that no longer meet eligibility requirements as of November 2, 2018 may not continue affiliation or participate in any way with a licensed EMS agency or onboard a OEMS licensed vehicle.

The Office of EMS, Regulation & Compliance Division will be outsourcing the collection of finger prints for background checks to the state contract vendor, FieldPrint.  Fieldprint fingerprinting will go live on January 1, 2020.  Once Fieldprint is “live”, the Virginia Office of EMS will no longer process paper-based fingerprint cards.

I am a licensed / certified EMS provider out of state, can I practice with a Virginia-based EMS agency?

Non-Virginia certified/licensed EMS providers from a compact state who wish to practice (other than the temporary day to day movement between state lines) for a Virginia Office of EMS (OEMS) licensed agency, must have prior approval by the Virginia OEMS. Virginia licensed EMS agencies must apply online for any out-of -state provider(s) from a compact state to have privileges to practice in Virginia.  Once approved, the out of state provider(s) may practice within the Commonwealth of Virginia, under this compact, on their home state license/certification, for a period no longer than 30 calendar days, from the date approved.

Should the host EMS agency need the provider(s) longer than the 30 days afforded by this compact coverage; each individual provider must apply for reciprocity utilizing the 30 days of compact coverage for the processing of their Virginia reciprocity application.
